The use of equivalent technology must be approved in accordance with section 598.1 (l) of this part. (e) Prevent pump and valve leakage. Before December 22, 1999, the owner or operator must use one or more of the following methods to prevent overflow and leakage of all pumps and valves controlling liquid hazardous substances: (1) install unsealed pumps and valves, fail safe double seal pumps and valves or equivalent technology; (2) Implement pump and valve maintenance and repair plan. The inspection frequency and maintenance and repair scope must be based on at least five years of actual operation and service records, manufacturer's recommendations or similar operation records. The plan basis, inspection frequency and maintenance and repair scope must be determined in the leakage prevention report; Or (3) Install the pump and valve in the sump, such as oil pan, gasket or secondary sealing system. Catchment basins must be designed and constructed so that the permeability of the stored material is less than or equal to 1 x 10-6 cm/sec and compatible with the stored hazardous material. If catch basins are used, they must be checked daily for fluid accumulation and have sufficient capacity to contain any spillage that may accumulate in the catch basins. (f) Upgrade existing solid storage.
Hazardous substances that are water-soluble solids at ambient temperature must be stored in containers that prevent rainwater from entering, or in areas protected by buildings or similar enclosures that prevent rainwater from entering. The container (including the floor) must be designed and constructed so that its permeability to the stored material is less than or equal to 1 x 10-6 cm/sec. (g) Upgrade container storage area. (1) By December 22, 1999, containers must meet the following requirements: 6 NYCRR Part 598 – October 11, 2015 Page 11 of 35 598.5 (g) (i) Incompatible substances stored in containers must not be close to each other. At a minimum, they must be separated by 30 feet; Firewalls with a fire resistance rating of not less than two hours; Separate and independent dykes; Or other equivalent system to prevent accidental mixing and reduce the possibility of accidents, leaks or leaks; (ii) Containers containing materials that may react with water to generate heat, cause pressure buildup in the container, or cause fire, explosion, or other adverse reactions, such as warehouses or wind shelters, must be provided with enclosures. The enclosure must protect the container from water exposure, be designed to withstand storms, and be fixed to the ground; (iii) The container must be located in an area with impervious floors and surrounding kerbs or ramps high enough to accommodate 110% of the largest container contents or the total volume of interconnected containers that may spill over the containment area, whichever is greater.
