6) The Department may issue written investigation results to prove the existence of Level I or Level II conditions, but will not implement the delivery ban within a period of not more than 180 days. If there is no evidence that the tank system leaks, and the implementation of the transportation ban will endanger public health or safety. (b) Prohibitions. (1) Delivery is prohibited. No person shall deliver, or cause to be delivered, hazardous substances to any tank system labeled. No person shall accept the delivery of hazardous substances to any tank system with labels attached. 6 NYCRR Part 598 – October 11, 2015 Page 28 of 35 598.13 (b) (2) Tampering and removal of labels is prohibited. No person shall tamper with or remove, or cause to be tampered with or removed, the labels attached to the tank system unless authorized by the Department. (c) Notification. (1) Notice of non delivery to facility and carrier. A label affixed to the filler pipe of the tank system constitutes a no delivery notice. (2) The facility notifies the carrier. After the department labels the filling pipe of the tank system, the enterprise must notify all carriers who usually deliver hazardous substances to the tank system to prohibit delivery before the next scheduled delivery of hazardous substances. The factory must keep any communication records about prohibited delivery. (d) Terminate the delivery ban.
(1) The department may terminate the delivery ban at its own discretion, or after the completion of compliance review or quick hearing. (i) Sectoral initiatives. If the department voluntarily terminates the delivery ban, the department will send a written notice to the factory to confirm that the ban has been terminated. The department will send the notice by registered mail to the mailing address listed in the current facility registration or permit. (ii) Review compliance submissions. (a) The enterprise can submit information to the department at any time to prove that the enterprise meets the requirements or has corrected the conditions that urge the department to implement the prohibition. (b) After submitting the information to the Department of Public Information, the Department will designate a person to review the information submitted and provide the following written decision. (c) The designated person will provide a written decision to the facility within five working days after the department receives the facility submission. If the designated individual decides to refuse to terminate the delivery ban, the decision will state the reasons for the refusal, including a description of any defects in the information provided by the facility. (d) According to Article 78 of the Code and Rules of Civil Procedure, the decision to designate an individual will constitute the final institutional decision and may be challenged. 6 NYCRR Part 598 – October 11, 2015 Page 29 of 35 598.13 (d) (e) Department will retain records generated during employee review for one year. (iii) Expedite the hearing. (a) Not later than 15 days after the tank filler is labeled, the Department will provide the facility with an opportunity to provide evidence on whether the Department has erroneously determined that the facility has any limited problems with Level I or Level II conditions. Notice of such hearing will be sent together with written notice of any delivery injunction issued pursuant to 598.13 (a) (1) (ii) or (a) (2) (iii) of this part.
